No Excuse Produce AAU -Release of Liability for Participation in AAU Program
This Release of Liability Agreement ("Agreement") is entered into by the undersigned parent/legal guardian ("Parent/Guardian") of the minor child ("Participant") identified below, and No Excuse Produce ("Organization"). By signing this Agreement, the Parent/Guardian acknowledges and agrees to the following terms and conditions regarding the Participant's voluntary participation in the AAU program organized by No Excuse Produce.
1. Acknowledgment of Risks The Parent/Guardian understands that participation in the AAU program involves physical activities and that there are inherent risks of injury associated with such activities. These risks may include, but are not limited to, accidents, falls, collisions, or physical exertion, all of which may result in injury to the Participant.
2. Assumption of Risk The Parent/Guardian agrees that the Participant is voluntarily choosing to participate in the AAU program, fully understanding the potential risks of injury involved. The Parent/Guardian acknowledges that the Organization cannot eliminate all risks, and by allowing the Participant to participate, accepts and assumes all such risks.
3. Release and Waiver of Liability The Parent/Guardian, on behalf of themselves and the Participant, hereby releases and holds harmless No Excuse Produce, its employees, volunteers, coaches, agents, officers, and affiliates from any and all liability, claims, demands, actions, or causes of action arising from or related to any injuries, accidents, or damages sustained by the Participant while participating in the AAU program. This release applies regardless of whether the injury or damage is caused by negligence, accident, or any other reason.
4. Medical Treatment In the event of an injury or medical emergency, the Parent/Guardian consents to medical treatment being provided to the Participant as deemed necessary by a qualified medical professional. The Parent/Guardian agrees to assume responsibility for any costs associated with such medical treatment.
5. Indemnification The Parent/Guardian agrees to indemnify and hold harmless No Excuse Produce from any and all claims, liabilities, costs, or expenses (including legal fees) arising from the Participant’s participation in the AAU program, including any injuries, damages, or claims made by third parties.
6. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the state where the AAU program is conducted.
7. Acknowledgment of Understanding By signing below, the Parent/Guardian acknowledges that they have read this Agreement in its entirety, understand the risks involved, and voluntarily agree to release No Excuse Produce from liability and waive any legal claims related to the Participant’s involvement in the AAU program.
